Revamping MIDC Industrial Layouts: New Guidelines for Land Conversion

To meet mounting demands for industrial expansion, foreign direct investment (FDI), and large-scale projects, the Maharashtra Industrial Development Corporation (MIDC) has issued new guidelines for making changes in industrial area layouts. The new circular, released on December 2, 2022, points out major shifts in land allocation—offering flexibility without sacrificing essential infrastructure. Here’s what you need to know:

Key Changes in MIDC Industrial Layouts

Every MIDC-developed industrial zone reserves:

  • 10% for open spaces.
  • 5% for amenities
  • 20% for support services

However, to accommodate urgent industrial needs, MIDC now allows conversion of reserved plots under specific conditions.

Conditions for Land Conversion

1. Eligibility Criteria

  • The plot must have been auctioned at least three times with no demand.
  • Applications must be submitted to the Minor Committee, with prior approval from the MIDC CEO.

Converting Open Spaces for Industrial Use

1. Open Spaces With Plantation

  • Conversion may be permitted in special cases, provided:
    • A plantation history (number, type, age of trees) is submitted.
  • Adjacent plots may be allotted for expansion, but the entrepreneur must disclose development plans.

2. Open Spaces Without Plantation

  • Conversion is allowed only if:
    • The remaining land parcel retains a regular shape.
    • Proper access roads are maintained.
  • Important Note: If the remaining land loses road access or requires HT line shifting, the allottee bears the cost.

3. Converting Amenity / Support Service Land for Industrial Use

  • Applications will be considered only if the minimum reserved space (as per Development Control Regulations) is maintained.
  • Surplus land can be allotted if:
    • The remaining parcel is properly shaped.
    • Access roads are intact.
  • Responsibility Clause: If road access is lost or HT lines need relocation, the allottee must cover the expenses.

Why does this matter to Industries

These changes offer greater flexibility for businesses looking to expand, invest, or set up large-scale projects. However, MIDC ensures that essential infrastructure and green spaces are not compromised.

Conclusion:

MIDC’s updated land conversion policy opens new doors for industrial growth while ensuring sustainable development. By allowing flexible use of underutilized plots—with clear safeguards for infrastructure and green spaces—it strikes a smart balance between business needs and urban planning. Industries eyeing expansion or large-scale projects should act swiftly to leverage these opportunities while adhering to the guidelines.
