Charges on MIDC plots for extension of time limit are imposed by the Maharashtra Industrial Development Corporation (MIDC) upon plot owners for failing to develop their respective plots within the stipulated time limit. These charges are imposed to deter lateness in the development of land for industrial use. Earlier, if a plot holder did not attain the minimum Floor Space Index (FSI) or obtain a Building Completion Certificate within the given time period, MIDC would charge an extension fee of 5% of the prevailing plot rate every year. However, even after collecting these charges, plot holders would delay development, so MIDC revised its policy. The new policy intends to increase enforcement of development deadlines to achieve optimal use of industrial land and minimize unnecessary delays in plot development.
Based on the circulars dated 06.03.2013 and 29.04.2014, the first extension will be at a non-refundable additional charge of 10% (in D and D+ regions) and 25% (in A, B, and C regions). The second extension will be at 10% (in D and D+ regions) and 40% (in A, B, and C regions) of the prevailing MIDC rate, and this will be effective.
For such plots, the first extension would be at 25%, and the second extension at 50% of the prevailing MIDC rate. This would be for all areas.
For any additional extensions beyond those mentioned above, a non-refundable extension fee of 5% of the prevailing MIDC rate would be levied.
If the extension fee is higher than the current value of the plot, the lower of the two, i.e., either the fee that is required or the current value of the plot, will be charged. The plot value will be determined on the basis of current MIDC rate plus an additional 10%, and the width of the road charges where required will also be included in the extension fee to be paid.
The plot holders who have adhered to the conditions laid down in the COVID-19 circular are required to be given the respective benefits under the said circular.
Plot holders must have sanctioned plans to be considered eligible to obtain the benefits of this scheme. Eligible holders must have completed construction and initiated production, halted production, or yet to initiate production. Evidence of compliance with the Corporation's development control rules must be established through a report from the responsible authority.
Plot owners who were provided a 90-day free extension in the circular dated 08.09.2015 and are yet to be issued a completion certificate within the said time will be levied an extension charge of 5% of the prevailing rate for further extensions.
The plots not approved by plan, where construction is not completed, where production has not yet started, or where the development time and expansions had expired before 31.08.2013 are excluded from the scheme. These plots will be inspected and taken over forthwith by the regional office and development control authority according to Corporation rules.
The final date of receipt of complete applications under this scheme is 30.06.2023.
A grace period of 90 days for procuring Building Plan Approval will be granted, on payment of an additional surcharge of 5%, w.e.f. the date of this circular.
The new instruction has been issued for availing special extension scheme with respect to the plots where no approved building plan is available. According to Circular No: E-28833 dated 23.01.2023, first the date for development of the plot was 30.06.2023. Afterwards, within a period of 90 days from the said circular date, upon production of necessary documents, the period for application has now been extended.
On receipt of approval for the special extension, the plot holders have to obtain building approval and complete the construction within the extended duration awarded by the special extension.
Reiterating the provisions included in Circular No. E-28833, dated 23.01.2023, the following changes are made:
The requirement to obtain sanction of the plan, as required under Condition No. 7, will be relaxed for 90 days from the issue date of this circular. However, a one-time additional premium at 5% of prevailing rates will be levied for the extension.
Rules for application under special extension scheme for plots where building plan sanction is not available have been modified. Applications need to be submitted within 90 days of issue of this circular, along with all papers.
Upon the grant of special extension, the plot owner has to seek building approval and complete development within the special extension period granted.
